Ultima Dental Systems (UDS) (a division of Genesis Industries, Incorporated warrants to the original retail purchaser of the UDS Unit for a period of three (3) years from the date of invoice that the UDS Unit will be free from defects in material or workmanship under normal use and service.
Handpieces and Scaling System are warranted to the original retail purchaser for one (1) year from date of invoice to be free from defects in material and workmanship under normal use and service.
Turbines for the High-Speed Handpieces are warranted to the original retail purchaser for six (6) months from the date of invoice to be free from defects in material and workmanship under normal use and service.
This warranty only applies to defects reported to UDS within the applicable warranty and period and which, upon examination by UDS, prove to be defective.
UDS will elect to repair or replace a defective component without charge within the applicable warranty period. The charge for shipping the defective component is the responsibility of the purchaser and must be accompanied by an RMA (Return Material Authorization) number issued by UDS. The shipping charge to return the component to the purchaser is the resonsibility of UDS. In some cases, at UDS' sole discretion, it may be possible to provide the user with a repair kit, authorizing the user's technical staff to complete the repair. In such cases, the labor cost shall be the sole responsibility of the purchaser.
The warranty is not valid for damage or defects resulting from negligence, accident, unreasonable use, abuse, misuse or altering the unit without authorization from UDS or failure to seek and obtain repair or replacement in a timely manner.
UDS expressly disclaims and excludes any liability for consequential, incidental, indirect, or punitive damages or financial loss to people or property resulting from the breach of warranty or from improper operation of the equipment.
THIS LIMITED WARRANTY IS UDS' SOLE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. UDS MAKES NO IMPLIED WARRANTIES OF ANY KIND INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS WARRANTY IS LIMITED TO REPAIR OR REPLACEMENT, AT UDS' OPTION, OF DEFECTIVE COMPONENTS.
No action may be brought against UDS for breach of this limited warranty, or any implied warranty or for any claim arising out of or relating to the products more than ninety (90) days following the expiration of the applicable warranty period. UDS shall not, in any event, be responsible for any cost or claim beyond the purchase price paid by the original purchaser.
